PostForged — Terms of Service

These Terms of Service ("Terms") govern your use of the PostForged application and website ("PostForged," "the app," "we," "us"). PostForged is published by VSBIE — Vivid Software, Building Innovative Ecosystems. By downloading, installing, or using PostForged, you agree to these Terms. If you do not agree, do not use the app.

1. What PostForged is

PostForged is a personal email client that runs entirely on your own device and connects directly to your email accounts (Google / Gmail and Microsoft / Outlook) through their official APIs. There is no PostForged server that receives, stores, or processes your email. How your data is handled is described in our Privacy Policy, which is incorporated into these Terms.

2. License

Subject to these Terms and your chosen plan, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use PostForged on devices you own or control, for your own use. You may not resell, redistribute, rent, sublicense, reverse-engineer (except where that right cannot be lawfully restricted), or remove proprietary notices from the app.

3. Plans, billing & payments

PostForged is offered in three plans. Purchases are processed by the platform you buy through (the Apple App Store or Google Play), not by us directly. Your purchase is therefore also subject to that platform's terms, billing, and refund policies.

3.1 Free

The Free plan is provided at no cost and may be changed or discontinued at any time. It is offered "as is" with no commitment of continued availability.

3.2 Pro (subscription)

• Recurring billing. Pro is a subscription billed on a recurring basis (e.g., annually) through your app store account. Unless you cancel, it automatically renews at the then-current price, and your payment method is charged at the start of each renewal term.
• Cancellation. You may cancel at any time in your App Store or Google Play subscription settings. Cancellation stops future renewals; you keep Pro features until the end of the current paid period.
• Refunds. Refunds for subscriptions are handled by Apple or Google under their respective policies. We do not separately process subscription payments and generally cannot issue refunds directly.
• Price changes. We may change the Pro price for future renewal terms. Where required, you will be notified in advance and may cancel before the change takes effect.

3.3 Lifetime (one-time purchase)

• What it includes. A one-time payment grants you access to PostForged, including the features available at purchase and maintenance and bug-fix updates released while the product continues to be offered.
• What it does not include. It is not a promise of specific new features, of support for every future operating-system version, or of the app operating forever. New major features or add-ons may be offered separately.
• If PostForged is discontinued. We may discontinue the product. If we do, we will provide reasonable advance notice (at least 30 days where practical), and Lifetime access ends when the product is retired. Because purchases are made through the App Store or Google Play, any refund at that point is handled under those platforms' policies.
• Dependence on third parties. PostForged relies on services operated by Apple, Google, and Microsoft. If any of them changes or removes access to the APIs PostForged depends on, some features may stop working through no fault of ours; this does not by itself entitle you to a refund beyond applicable platform policy.

4. Changes to and discontinuation of the service

We may add, change, suspend, or discontinue any part of PostForged at any time. We will use reasonable efforts to give notice of material adverse changes, including discontinuation of a paid plan as described in Section 3.3. We are not liable for modifying or discontinuing the app except as expressly stated in these Terms or as required by law.

5. Third-party services

PostForged connects to and depends on services provided by Google, Microsoft, Apple, and Google Play. Your use of those services is governed by their own terms and privacy policies. We are not responsible for the availability, changes, outages, security, or policies of any third-party service.

6. Bring-your-own AI keys

Optional AI features require you to supply your own API key from an AI provider (e.g., Google Gemini). That key is stored only on your device, and requests are made directly from your device to the provider. You are solely responsible for your API key and for any cost or usage charged by that provider. Your use of an AI provider is governed by that provider's terms.

7. Acceptable use

You agree to use PostForged only for lawful purposes and in compliance with the terms of your email and AI providers. You are responsible for the content you send, forward, or store using the app.

8. Disclaimer of warranties

PostForged is provided "as is" and "as available," without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or compatible with every device, email account, or future operating-system version.

9. Limitation of liability

To the maximum extent permitted by law, VSBIE and PostForged will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data, profits, or email. Our total liability for any claim relating to PostForged is limited to the amount you paid for the app in the twelve (12) months before the claim (or, for a one-time Lifetime purchase, the amount you paid for it). Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

10. Termination

You may stop using PostForged at any time and delete the app and its local data. We may suspend or terminate your license if you materially breach these Terms. Sections that by their nature should survive (including 8, 9, and 11) survive termination.

11. Governing law

These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws rules. The exclusive venue for disputes not subject to a platform's dispute process will be the state or federal courts located in Florida, to the extent permitted by law.

12. Changes to these Terms

We may update these Terms. If we make material changes, we will update the date above and, where appropriate, note it in the app. Continued use after changes take effect means you accept the updated Terms.
